WE ASK THAT YOU READ THIS PRIVACY POLICY CAREFULLY AS IT CONTAINS IMPORTANT INFORMATION ON WHO WE ARE, HOW AND WHY WE COLLECT, STORE, USE, AND SHARE PERSONAL INFORMATION, YOUR RIGHTS IN RELATION TO YOUR PERSONAL INFORMATION AND ON HOW TO CONTACT US AND SUPERVISORY AUTHORITIES IN THE EVENT YOU HAVE A COMPLAINT.

Magnitude Software, Inc. ("Magnitude") has created this privacy policy in order to demonstrate our commitment to privacy. This privacy policy discloses our information gathering and usage practices. Magnitude does not sell or rent your personal identification to third parties. We will only release registration information to third parties to comply with the law. Magnitude may use this information to contact you for Magnitude sales and marketing purposes.

Who We Are. Magnitude Software, Inc., including its subsidiaries (collectively referred to herein as “the Magnitude Group,” “we” or “us”), collects, uses and is responsible for certain personal information about you. When we do so in the European Union we are regulated under the General Data Protection Regulation which applies across the European Union (including in the United Kingdom), and we are responsible as controller of that personal information for the purposes of those laws.

What does this privacy policy cover? This privacy policy covers our use of your personal information that is collected through or in connection with one of the Magnitude Group’s web sites (a “Site”).

The Security of Your Information. We work diligently to protect the security of your personal information. As a global company, we may transfer your information to other countries and are committed to providing a consistent level of protection for your information regardless of the country.

Registration. A Site’s registration forms allow you to provide us contact information. By submitting your personal data to us, you will be treated as having given your permission to utilize that personal data. The Magnitude Group may use your contact information to send you information about our companies as well as promotional material. The Magnitude Group may periodically conduct individual voluntary surveys. We encourage participation in these surveys because they provide us with important information that helps us to improve the types of services we offer, and how we provide them to you.

Email Privacy. It is our policy to remove any registered user from our marketing database promptly upon request. The Magnitude Group’s customers may continue to receive technical updates related to use of the Magnitude Group’s products and/or services.

Unsubscribing. Every promotional e-mail communication from the Magnitude Group will contain clear instructions on how to be removed from that mailing list.

IP Addresses. We use your IP address to help diagnose problems with our server, and to administer a Site. Your IP address is also used to gather broad demographic information.

Collection of non-personal information. We may automatically collect non-personal information about you such as the type of internet browsers you use or the web site from which you linked to a Site. We may also aggregate details that you have submitted to a Site (for example, your age and the town where you live). You cannot be identified from this information and it is only used to assist us in providing an effective service on a Site. We may from time to time supply third parties with this non-personal or aggregated data for uses in connection with a Site.

Cookies. Cookies are small pieces of information that are stored in a browser-related file on your device when you use a web site. Cookies may collect a unique identifier, user preferences and profile information, and membership information. The Magnitude Group’s server(s) will query your browser to see if there are “cookies” previously set by a Site. We use cookies to improve the user experience, like allowing users to login without typing the registered email address or registration number and password. We also use them to deliver information and fresh content specific to your interests. The cookies placed by the Magnitude Group’s server(s) are readable only by the Magnitude Group, and cookies cannot access, read or modify any other data on a computer.

Cookies are widely used on most major web sites. Some cookies may remain on the user’s computer after they leave the web site, and the majority are set to expire within one (1) year from your visit to the web site. While we do not necessarily offer an opt-out for cookies on a Site, browsers provide you information and control over cookies. You can also set your browser to refuse all cookies or accept only cookies returned to the originating servers. Who We Share Information With.

  1. Within Corporate Organization. The Magnitude Group is a multinational organization with legal entities, business processes, management structures, and technical systems that cross borders. The Magnitude Group may share your personal information within the Magnitude Group’s corporate organization, and may transfer the information to countries in the world where the Magnitude Group conducts business. Some countries may provide less legal protection for your personal information.
  2. Mergers and Acquisitions. Circumstances may arise where for business reasons, the Magnitude Group decides to sell, buy, merge or otherwise reorganize its businesses in the United States or another country. Such a transaction may involve the disclosure of personal identifying information to prospective or actual purchasers, and/or receiving such information from sellers. It is the Magnitude Group’s practice to seek appropriate protection for information in these types of transactions.
  3. Agents. The Magnitude Group employs or engages other companies and individuals to perform business functions on behalf of the Magnitude Group. These persons are provided with personal identifying information required to perform their functions, but are prohibited by contract from using the information for other purposes. These persons engage in a variety of functions which include, but are not limited to, fulfilling orders, delivering packages, removing repetitive information from customer lists, analyzing data, providing marketing assistance, processing credit card payments and providing customer services.
  4. Affiliated Businesses. The Magnitude Group works closely with affiliated businesses operating web site stores, providing services or selling products on each other’s web sites. These businesses identify themselves to customers. Customer information related to a transaction with an affiliated business is shared with that affiliated business.
  5. Marketing Analysis by Third Parties. The Magnitude Group reserves the right to disclose to third parties personal information about visitors to a Site for marketing analysis; however, any information disclosed will be in the form of aggregate data that does not describe or identify an individual.
  6. Disclosure to Governmental Authorities. Under certain circumstances, personal information may be subject to disclosure pursuant to a judicial or other government subpoenas, warrants or orders.

How Long Your Personal Information Will Be Kept. We will hold your data for the period we are required to by applicable law.

Advertising and Third-Party Links. A Site may contain non-advertising links to a variety of third-party sites to enhance the user experience. The Magnitude Group has no control of either the content or privacy policies of such web sites, nor should such links be considered an endorsement of these sites except where otherwise noted. We recommend that you check the policy of each web site you visit and contact the owner or operator of such web site if you have any concerns or questions.

General Data Protection Regulation Specific Clauses

  1. Transfer of Your Information Out of the EEA. We may transfer your personal information to the following which are located outside the European Economic Area (EEA) as follows: United States, Canada, and India. Such countries do not have the same data protection laws as the United Kingdom and EEA. Whilst the European Commission has not given a formal decision that such countries provide an adequate level of data protection similar to those which apply in the United Kingdom and EEA, any transfer of your personal information will be subject to a European Commission approved contracts (as permitted under Article 46(2) of the General Data Protection Regulation) that are designed to help safeguard your privacy rights and give you remedies in the unlikely event of a misuse of your personal information.   2. Your Rights. Under the General Data Protection Regulation you have a number of important rights free of charge. In summary, those include rights to:
    • Fair processing of information and transparency over how we use your use personal information.
    • Access to your personal information and to certain other supplementary information that this Privacy Policy is already designed to address.
    • Require us to correct any mistakes in your information which we hold.
    • Require the erasure of personal information concerning you in certain situations.
    • Receive the personal information concerning you which you have provided to us, in a structured, commonly used and machine-readable format and have the right to transmit those data to a third party in certain situations.
    • Object at any time to processing of personal information concerning you for direct marketing.
    • Object to decisions being taken by automated means which produce legal effects concerning you or similarly significantly affect you.
    • Object in certain other situations to our continued processing of your personal information.
    • Otherwise restrict our processing of your personal information in certain circumstances; and
    • Claim compensation for damages caused by our breach of any data protection laws.

  3. Keeping Your Personal Information Secure. We have appropriate security measures in place to prevent personal information from being accidentally lost, used or accessed in an unauthorized way. We limit access to your personal information to those who have a genuine business need to know it. Those processing your information will do so only in an authorized manner and are subject to a duty of confidentiality.
  4. We also have procedures in place to deal with any suspected data security breach. We will notify you and any applicable regulator of a suspected data security breach where we are legally required to do so.

Privacy Policy Changes and Opt-Out Rights

  1. Changes to Privacy Policy. This privacy policy was last updated on May 25, 2018. The Magnitude Group reserves the right to change its privacy policy statement at any time. A notice of any material change will be posted on a Site for thirty (30) days prior to the implementation of such change.
  2. Opt-Out Right. As stated above, you have the right at any time to cease permitting personal information to be collected, used or disclosed by the Magnitude Group and/or by any third parties with whom the Magnitude Group has shared and/or transferred such personal information. Your right of cancellation may be exercised by contacting the Magnitude Group via e-mail at [legal@magnitude.com], telephone or certified postal mail. After processing the cancellation, the Magnitude Group will delete your personal information from its data base, as required by law.
